			<content:encoded><![CDATA[<p>Zacks &amp; Freedman’s attorneys won several major arbitration awards in 2011. Here are three of the highlights:</p>
<p>1.   After years of careful searching, our clients purchased what they thought was their dream home in San Francisco. Unfortunately, the sellers failed to disclose hidden water intrusion problems at the property. Working with some of the Bay Area’s top engineers, Zacks &amp; Freedman’s attorneys took the case to arbitration.</p>
<p>Following 12 days of hearings, the Arbitrator found our attorneys had successfully proven intentional fraud, and awarded our clients the rare remedy of rescission. This amounted to return of the clients’ more than $3 million purchase price, more than $800,000 in interest and costs, and “prevailing party” status for the award of attorney’s fees.</p>
<p>&nbsp;</p>
<p>2.   Over the course of several years, our client partnered with a real estate broker to purchase and develop properties at several locations in San Francisco. Our office was contacted when the broker began defaulting on her obligations to the client on a particularly expensive and lengthy project in Russian Hill.</p>
<p>Upon further investigation, our office was able to determine that instead of diligently pursuing the development project for our client’s benefit, the broker had established a personal residence and offices in the partnership’s property and used our client’s funds to feather her own nest – including the installation of a private elevator, a luxury roof deck and state-of-the-art audio-visual equipment – to the exclusion of any investment in the remainder of the multi-unit property.</p>
<p>Zacks &amp; Freedman’s attorneys took the case to arbitration. After five days of hearings, the Arbitrator found the broker had committed constructive fraud and awarded our client the return of his entire investment, plus costs and attorney’s fees, for a total award in excess of $700,000.</p>

<p>3.   After our clients entered into a contract to sell their condominium, the upstairs owner began pressuring them to install noise-cancelling materials in the downstairs ceiling. He also demanded that they enter into mediation or pay him a sum of $15,000. Not wanting to live below such a person and share ownership of common areas with him, the buyer backed out of the sale.</p>
<p>Zacks &amp; Freedman’s attorneys took the case against the upstairs owner to arbitration. After two days of hearings, the Arbitrator awarded our clients more than $180,000 in damages, attorney’s fees, and costs.</p>

Singer, Jr. has joined our firm.  Mr. Singer has over 20 years of legal experience representing large and small businesses in litigation, commercial transactions and bankruptcy proceedings.  Mr. Singer has extensive experience in state and federal courts, as well as court-ordered mediations.</p>
<p>For the last seven years, as in-house counsel for the Lembi Group, Mr. Singer has focused his practice solely on the issues faced by one of the largest San Franciscoreal estate owners, winning numerous cases, including the landmark decision in <em>1100 Park Lane Associates v. Feldman</em>, which protects landlords against retaliatory wrongful eviction cases.  Mr. Singer’s tenure as general counsel in the tumultuous past five years has provided him with unparalleled experience in the political, economic and legal issues faced bySan Francisco apartment and hotel owners.</p>
